Terms of Service

1. Acceptance of Terms

By accessing or using HitnMis ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use the Platform.

These Terms apply to all visitors, users, and others who access or use HitnMis, including the website at hitnmis.gg, any associated Discord bots, and all related services.

2. Description of Service

HitnMis provides tools for Discord communities, including but not limited to:

• Event creation, scheduling, and RSVP management
• Tournament and bracket organization
• Player availability tracking
• Public profile and link-in-bio pages
• Coaching marketplace and session scheduling
• Server XP tracking and leaderboards via Discord bot

We reserve the right to modify, suspend, or discontinue any part of the service at any time with or without notice.

3. Accounts and Registration

HitnMis uses third-party OAuth providers (Discord and Google) for authentication. By signing in, you authorize us to receive and store your basic profile information from those providers in accordance with our Privacy Policy.

You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and up to date

You must be at least 13 years old to use HitnMis. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Acceptable Use

You agree not to use HitnMis to:

• Violate any applicable law or regulation
• Harass, abuse, threaten, or harm other users
• Post or distribute spam, malware, or malicious content
• Impersonate any person or entity
• Scrape, crawl, or harvest data from the Platform without express permission
• Attempt to gain unauthorized access to any part of the Platform or its infrastructure
• Use automated bots or scripts to interact with the Platform in a disruptive manner
• Engage in any activity that interferes with or disrupts the Platform's services

Violation of this section may result in immediate account suspension or termination without notice.

5. User Content

"User Content" means any information, text, images, links, or other material you submit, post, or display on HitnMis — including profile bios, social links, event descriptions, and coaching listings.

You retain ownership of your User Content. By submitting content to HitnMis, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute that content solely for the purpose of operating and improving the Platform.

You represent and warrant that your User Content:

• Does not infringe any third-party intellectual property rights
• Does not contain defamatory, obscene, or unlawful material
• Does not violate any person's privacy rights

We reserve the right to remove any User Content that violates these Terms or our Code of Conduct without prior notice.

6. Username and Profile URLs

When you create a profile, you may claim a unique username that forms your public profile URL (e.g., hitnmis.gg/yourname). Usernames must not:

• Impersonate another person, brand, or organization
• Contain offensive or hateful language
• Match a reserved platform route (e.g., "admin," "api," "legal")

We reserve the right to reclaim usernames that violate these rules, are inactive for extended periods, or are needed for platform operations.

7. Coaching Services

HitnMis facilitates connections between coaches and players but is not a party to any coaching arrangement. Coaches are independent service providers, not employees or agents of HitnMis. Please review our separate Coaching Terms for rules specific to coaching sessions, payments, and cancellations.

8. Intellectual Property

The HitnMis name, logo, and all Platform-owned content — including but not limited to design, code, graphics, and text created by HitnMis — are the exclusive property of HitnMis and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or distribute our proprietary content without express written permission.

9. Disclaimers

HitnMis is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Platform is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, HitnMis and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform, even if advised of the possibility of such damages.

11. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms or our Code of Conduct. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will remain in effect.

You may delete your account at any time from your dashboard settings. Deletion is permanent and cannot be reversed.

12. Changes to These Terms

We may update these Terms from time to time. We will notify users of significant changes via the Platform or Discord community. Continued use of HitnMis after changes take effect constitutes acceptance of the updated Terms. The "effective date" at the top of this page reflects the date of the last revision.

13. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Platform will be resolved through good-faith negotiation first, and then through binding arbitration if necessary.
